The Kyber Health Data products are comprised of data from many sources. Certain sources require attribution and other terms applicable to use of the data, which are below. These terms supplement and do not replace the terms contained in any contract you have with Kyber Health Data.
- The Kyber Health Data product uses publicly available data courtesy of the U.S. National Library of Medicine (NLM), National Institutes of Health, Department of Health and Human Services; NLM is not responsible for the product and does not endorse or recommend the Kyber Health Data product or any other product. The Kyber Health Data product does not reflect the most current or accurate data available from NLM.
- The Kyber Health Data product includes SNOMED Clinical Terms® (SNOMED CT®) which is used by permission of the International Health Terminology Standards Development Organisation (IHTSDO). Kyber Health Data that is subject to the LOINC terms is found only within the LOINC_CODE Column of the EMR_RESULTS Table. If you do not have access to this Column, the LOINC terms do not apply to your use of the data. - Certain Kyber Health products include information categorizations based on the WHO Collaborating Centre for Drug Statistics Methodology
- Certain Kyber Health Data products may be accessible via a portal, user interface or other software (“Portal”). If you use a Portal to access Kyber Health Data products, you shall not:
(i) attempt to obtain, receive, review, or otherwise use or have access to the source code for the Portal (or any part thereof) by decompilation, disassembly or other means except as is required to be permitted under applicable law;
(ii) copy, reverse engineer, translate or modify the Portal except as is required to be permitted under applicable law;
(iii) sublicense, transfer, rent or lease the Portal or use it as part of a service bureau to provide services or access to the Portal or as a module for other software;
(iv) represent that you possess any proprietary interest in the Portal;
(v) test the Portal or use the Portal in connection with any benchmark tests, evaluation, or any other tests of which the results are designated or likely to be published in any form or media, or otherwise made available to the public;
(vi) directly or indirectly, take any action to contest intellectual property rights evidenced by or embodied in or connected or related to the Portal or infringe them in any way;
(vii) register, nor have registered, any trademarks, trade names, symbol or domain name related to the Portal;
(viii) use the name, trademarks, trade-names, and logos of the Portal in any manner whatsoever;
(ix) use the Portal for the purpose of building a similar or competitive product;
(x) share their unique login and password or other form of personal authentication that would allow unauthorized access and use of the Portal;
(xi) use the Portal in order to engage, directly or indirectly, in development of any product which is a derivative work of the Portal or infringes intellectual property rights related to the Portal; and
(xii) provide Portal access to users who are not authorized by Kyber Health Data.
Furthermore, any third party provider of a Portal makes no representations or warranties to you and shall have no direct or indirect liability to you.
